Terms of Service

By accessing and using mySavory.life (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, you should not use the Service.

These Terms of Service constitute a legally binding agreement between you and mySavory.life regarding your use of the Service.

mySavory.life provides a web-based platform for group dining decision-making through interactive games (Plinko, Spin Wheel, and Direct Choice), restaurant discovery features, and AI-powered dining advisors.

The Service allows users to create dining sessions, share them with participants, collect votes through gamified experiences, and view aggregated results to facilitate group restaurant selection.

You agree to:

• Provide accurate restaurant information when creating sessions
• Use the Service in compliance with all applicable laws and regulations
• Not use the Service for any unlawful, harmful, or fraudulent purposes
• Not attempt to gain unauthorized access to the Service or other user data
• Not interfere with or disrupt the Service or servers
• Not use automated tools (bots, scrapers) without permission
• Not impersonate others or misrepresent your affiliation
• Respect the intellectual property rights of mySavory.life and others

When you create a session, you retain all rights to the content you input (restaurant names, session names, etc.). However, you grant mySavory.life a license to use, store, and display this content as necessary to provide the Service.

You agree not to submit content that:

• Is illegal, obscene, defamatory, or hateful
• Violates intellectual property rights
• Contains malicious code or viruses
• Infringes on privacy or publicity rights

When you share a session link, anyone with that link can view the session details and participate. Session links should be treated as private and shared only with intended participants.

You are responsible for controlling access to your session links. mySavory.life is not responsible for unauthorized access to sessions if you share the link publicly or with unintended recipients.

Our Foodie Advisor feature uses AI to provide restaurant recommendations. These recommendations are provided "as is" and should be used as suggestions only.

mySavory.life does not guarantee the accuracy, completeness, or quality of AI-generated recommendations. Users should verify restaurant information independently before making dining decisions.

We are not responsible for dining experiences, food quality, or service at recommended restaurants.

Sessions are automatically deleted 7 days after creation. All associated data including restaurants, votes, and participants will be permanently deleted at that time.

You may request early deletion of your session data by contacting us at Dustin.beachy@virtuallyme.app.

The Service, including its design, layout, graphics, code, and content (excluding user-submitted content), is owned by mySavory.life and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without express written permission from mySavory.life.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

mySavory.life does not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, mySavory.life SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from your use of the Service shall not exceed $100 USD.

You agree to indemnify, defend, and hold harmless mySavory.life, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the Service

mySavory.life reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

The Service may contain links to third-party websites or services that are not owned or controlled by mySavory.life. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts located in the United States.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms.

Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and mySavory.life regarding your use of the Service and supersede all prior agreements.
